VISITR TERMS OF USE

1. INTRODUCTION
Welcome to Visitr. These Terms of Use ("Terms") govern your access to and use of the Visitr website and services (the "Platform"). By using the Platform you agree to these Terms. If you do not agree, please do not use the Platform.
Visitr is a Vancouver Island based accommodation directory operated from British Columbia, Canada. Our full registered business name will be published here once our incorporation is finalized. Your use of the Platform is also subject to our Privacy Policy.
2. WHAT VISITR IS — AND IS NOT
Visitr is a directory. We publish listings so guests can find places to stay on Vancouver Island and contact the host directly.
Visitr does not take bookings, hold reservations, process rent, damage deposits or any guest payment, and is not a party to any rental or accommodation agreement.
Every arrangement — availability, rates, agreements, deposits, payment, keys, cancellations and refunds — is made directly between the host and the guest.
The only money Visitr collects is the annual host membership fee (and any additional listing slot fees) described on the Platform.
3. DEFINITIONS
"Member" means any registered user of the Platform.
"Host" means a Member who publishes a listing for a property they own or are authorized to offer.
"Guest" means a person who browses listings and contacts hosts through the Platform.
"Listing" means the property information a Host publishes on the Platform.
"Enquiry" means a message a Guest sends to a Host through the Platform's contact form.
4. ELIGIBILITY
To use Visitr you must be at least 18 years old, have the legal authority to enter into a binding agreement, and use the Platform in compliance with Canadian and British Columbia law.
Visitr may decline or withdraw access at our discretion.
5. ACCOUNTS
Members must provide accurate information and keep their account credentials secure.
Guests must create an account before sending an enquiry or viewing host contact details. This exists to protect hosts from spam.
Visitr may suspend or terminate accounts that breach these Terms.
6. HOST MEMBERSHIP AND FEES
Hosting on Visitr requires a paid annual membership at the rate shown on the Platform. Membership includes up to two listings; additional listings are charged per extra listing slot.
Membership fees are paid through our third-party payment processor. Visitr does not store your card details.
Fees may change; changes apply at your next renewal.
Membership fees are non-refundable once a listing has been published, except where required by law.
Listings are reviewed before publication. Visitr may decline to publish, unpublish, or refuse renewal for any listing that is inaccurate, unlawful, or inconsistent with the character of the directory.
7. HOST RESPONSIBILITIES
Hosts are solely responsible for the accuracy of their listing, including photos, rates, availability and the description of the property.
Hosts must comply with all applicable laws and bylaws, including the BC Short-Term Rental Accommodations Act, local government business licence requirements, zoning rules, tax obligations and residential tenancy law where it applies.
Hosts offering stays under 90 nights must display a valid British Columbia short-term rental registration number, or a stated and accurate exemption. Visitr validates registration numbers against the provincial registry and will unpublish listings whose registration cannot be confirmed.
Hosts must respond to guest enquiries honestly and must not use the Platform to solicit unrelated business.
8. GUEST RESPONSIBILITIES
Guests are responsible for satisfying themselves as to the suitability, legality and condition of any property before entering into an agreement or sending money.
Guests should never send a deposit or rent without a written agreement directly with the host. Visitr can neither verify nor recover such payments.
Guests are responsible for the condition of a property during their stay under whatever agreement they make with the host.
9. ACCEPTABLE USE
Members must not use the Platform for unlawful activity, fraud, harassment or discrimination, must not scrape or republish Platform content, and must not attempt to reverse engineer or interfere with the Platform.
Content on the Platform may be viewed for personal, non-commercial use. All other reproduction requires our written permission.
10. LIABILITY AND DISCLAIMERS
Visitr acts only as a directory and is not a party to any agreement between a Host and a Guest.
The Platform and its content are provided "as is." Visitr makes no warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose or non-infringement.
Visitr does not guarantee the accuracy of any listing, the conduct of any Member, or the outcome of any stay.
To the fullest extent permitted by law, Visitr is not liable for any loss, damage or dispute arising from a listing, an enquiry, a stay, or any payment made between a Host and a Guest.
Hosts and Guests are responsible for arranging their own appropriate insurance.
11. CANCELLATIONS AND REFUNDS BETWEEN HOSTS AND GUESTS
Cancellation and refund terms are set by the Host and should be stated clearly in the listing or in the agreement between the parties.
Because Visitr never holds guest funds, we cannot process, mediate or reverse any refund. Disputes must be resolved between Host and Guest directly.
12. THIRD-PARTY LINKS AND CALENDARS
Listings may link to third-party sites and hosts may connect external calendars (for example an Airbnb iCal feed). Visitr is not responsible for the content or accuracy of third-party services, and displayed availability may lag behind the host's own calendar.
13. CHANGES TO THESE TERMS
Visitr may revise these Terms from time to time. The updated version is posted here with a new "last updated" date, and continued use of the Platform constitutes acceptance.
14. GOVERNING LAW AND DISPUTES
These Terms are governed by the laws of the Province of British Columbia and the applicable laws of Canada.
Disputes with Visitr should first be raised with us directly. If unresolved, they will be settled by arbitration in British Columbia, except for matters within the jurisdiction of the small claims court.
